It was hard to believe.

I mean, we saw it coming for a while...

But my dad, Kevin, died of cancer after a nearly decade-long battle. He was a fantastic trial lawyer, beloved by the community, and he was as smart and educated as the day is long.

But to our surprise, he didn't leave an updated estate plan. For nearly a year, my mom, sister, and I worked to piece their estate together, locate accounts and assets, and talk with the various companies involved.

It was a mess, but we got through it. Thankfully, he had remembered to name my mom on several of his accounts and policies, but even still, it was a task.

I'm Dan. Nice to meet you.

i found a passion...

I didn’t want anyone else to have to go through what we went through when my dad died. Losing a loved one is already hard enough. If I could help people take the small steps they needed to take to ensure their family would be okay if something happened to them, I was going to do it.

Today, I focus my practice entirely on estate and tax planning, as well as probate and trust administration. I help individuals and families achieve peace of mind by planning for their incapacity and eventual passing. I help them organize their assets, develop entities, and draft documents that ensure their wishes will be honored and their loved ones taken care of. I’m the family’s partner, waiting in the wings to make changes, provide guidance, and assist whenever life throws a curveball.

Please allow me to introduce myself.

St. Louis grown

I was born in St. Louis, Missouri. In the Manchester area, to be exact. I attended Rockwood Summit High School after my family moved out to Fenton, Missouri. But before all of that, my parents grew up in the small Missouri town of Perryville, and they brought that folksy sensibility with them to the big city. I’ve moved around a bit, but never too far. I spent the better part of a decade in school as a Mizzou Tiger in Columbia, and today I’ve laid roots in St. Charles with my wife, Molly, my two daughters, Natalie and Hannah, and my son, Jack. I wouldn’t change a thing.

Meet the Team

Tia West

Probate Case Manager

I am originally from Texas and have a Bachelor’s Degree from LeTourneau University in Longview, Texas. I have been a paralegal for 30 years which has allowed me to broaden my experience and knowledge as a litigation and probate paralegal.

Later in my career I developed a passion for handling probate matters. I am honored to use my understanding of probate law in a meaningful way. I value the opportunity to help families navigate through the probate process while maintaining a compassionate understanding of the feelings of those that I am privileged to assist in their time of need.

My husband, Chris, and I have two children who are a year away from graduating high school. I serve my community as a school board member and as an archery coach. We love animals and have dogs, cats and chickens.

It is a privilege to serve alongside someone with the competence, care and integrity that Dan brings to each of his clients.

How we get paid

Generally, we require half of the payment when we have determined the design of your plan following your Strategy Session and the other half when you sign your completed documents.

The Planning Process:
Creating a Comprehensive Estate Plan

The Basic Package

Whether you are a new parent or a retiree in your sunset years, you can benefit from the following basic estate plan:

Many estate planning goals – such as asset protection, tax avoidance, protecting irresponsible heirs, and providing for blended families, minors, and those with special needs – can’t be accomplished with these instruments alone. However, they serve as a foundation for more sophisticated planning, including the use of trusts and other legal entities.

Step-by-Step Estate Planning

We draft. You review.

You sign and fund.

Many clients ask us if the estate planning process can be completed securely online. With the recent Covid-19 pandemic and the ever-increasing demands on your time, we strive to be able to offer our clients a process that accommodates their busy schedules and desire to conduct business virtually. Take a look at our step-by-step roadmap.

Click here to contact us. Below, you’ll be able to schedule a time and place for your Strategy Session. We can conduct the Strategy Session over the phone, over Zoom, or in person at a location of your choosing.

After scheduling your Strategy Session, you will be sent an online Estate Planning Questionnaire. We ask that you try to complete as much of this form beforehand as possible. Please be aware that any information you insert into the form will automatically save, even if you don’t submit the form, so you can always come back to finish later!

The form asks for a variety of financial and personal information that we will need to develop a plan that meets your needs. The form will also give you the chance to designate individuals to serve as your agents under financial and medical powers of attorney or as guardians for your minor children should you pass away. However, you don’t need to identify these people right away if you don’t want to, as we will discuss this during your Strategy Session.

At the Strategy Session, we will review your Estate Planning Questionnaire with you, complete any missing pieces, and develop a plan that will best meet your goals. This meeting typically lasts between 1 and 2 hours. This meeting is all about your:

  • Family
  • Hopes
  • Intentions
  • Fears
  • Finances
  • Needs
  • Quirks

With that information, we will work to develop a plan for the care of your spouse if you pass away, if you have a spouse, and then develop a plan for any descendants or other beneficiaries. This will include a comprehensive analysis of any succession, continuing care, tax planning, and asset protection considerations.

At the end of this meeting, you will have a plan for your estate and your legacy. All we need to do then is put it together! If at all possible, we will also try to schedule your signing ceremony at this time so that we all have a deadline to work toward to keep things on track.

Either during or after the Strategy Session is completed, we will send you our attorney-client engagement agreement that can be electronically signed with a few clicks or taps. Once we have your signature, we can begin drafting your documents!

It is also at this time that we will ask for payment up front. We typically require at least 50% up front before we begin work.

After the Strategy Session is completed, within seven to ten business days, your attorney will have your estate planning documents drafted, and you will receive a summary statement explaining the terms of your estate plan.

It is very important that you review your estate planning documents carefully to make sure your wishes are accurately reflected. We ask that you have any proposed edits or other changes sent to us at least one week prior to your scheduled signing ceremony.

Once your documents are completed and reviewed, you will have the option to attend your scheduled signing ceremony or to have your documents mailed to you with detailed signing instructions so that you can execute them on your own. This is up to your preference.

If your estate plan employs a trust, you will be provided with a detailed memo on how to properly fund your trust. Don’t worry: we will follow up with you periodically to check on the status of your trust funding so that nothing gets forgotten. We also offer full trust funding services if you would prefer; don’t forget to ask your attorney about this!

AFTER SIGNING

Also, if you find that you have any additional questions, such as the funding of your estate plan, you will be able to schedule a final conference call with your attorney at your leisure.

Finally, you will have 90 days from the date you sign your documents to finalize any review of the documents and seek modifications. Unfortunately, any changes will mean you may need to re-execute the documents, but we want our clients to feel comfortable to sign their estate planning documents even if they are unable or uninterested in reviewing them in full (our estate planning documents are often quite lengthy). The 90-day window gives you time to fully digest everything in your plan and seek changes free of charge if you so desire.

Let's get started.
